RE: The tariff classification of household articles from South Africa

Dear Ms. Rodda:

In your letter dated August 15, 1997, you requested a tariff classification ruling.

The merchandise consists of a cupboard handle, a soap dish, a triple shelf, a sink plug, and a wine holder. The first item is the Daisy Cupboard Handle. The handle is made of zinc, shaped like a daisy, and measures 1.25 inches high by 1.5 inches wide. It will be used as a decorative handle on furniture doors and drawers. The applicable subheading for the handle will be 8302.42.3065, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal mountings, fittings and similar articles suitable for furniture, of iron or steel, of aluminum or of zinc. The duty rate will be 4.6 percent ad valorem.

Articles classifiable under subheading 8302.42.3065, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

The second item is an aluminum soap dish shaped like a fish. It measures 6.25 inches high by 4.75 inches wide, and is available in other designs.

The applicable subheading for the soap dish will be 7615.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for sanitary ware and parts thereof, of aluminum. The duty rate will be 3.8 percent ad valorem.

Articles classifiable under subheading 7615.20.0000, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

The next item is called the Wicker Triple Shelf. It is made of painted, galvanized, steel wire and trimmed with wicker. The triple shelf measures 18 inches high by 8 inches wide, and will be hung on the wall to hold articles.

The applicable subheading for the triple shelf will be 7323.99.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel, other, other, not coated or plated with precious metal, other, other, other. The duty rate will be 3.4 percent ad valorem.

Articles classifiable under subheading 7323.99.9060, HTS, which are products of South Africa are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

We are unable to classify the last two items, the Daisy Sink Plug and the Wine Holder, without additional information. For the Wine Holder, we need a photograph or a sample. And for the Daisy Sink Plug, please submit a sample, a breakdown by weight and value of the rubber and zinc components, and the exact type of rubber by name (i.e., neoprene, EPDM, etc.).

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
